LEGAL SERVICES MANAGER – RE ADVERTISED
MAIN PURPOSE
Reporting to the Chief Executive Officer, the Legal Services Manager will provide an in-house service that effectively supports business areas in their duty to comply with relevant laws of regulation, corporate governance and internal procedures.
DUTIES AND RESPONSIBILITIES
- Advising on general law issues and managing the legal issues of all areas of the Company, including but not limited to corporate, safety, security issues and sustainability.
- Anticipating and managing the (legal) risks connected with or resulting from the business strategy and operations.
- Securing compliance of business operations with relevant laws and regulations.
- Ensuring compliance with relevant laws of regulation, corporate governance and internal procedures.
- Managing litigations as an in-house legal counsel as well as liaising with external legal counsel on handling various matters.
- Developing and maintaining a compliance data base, dashboard and checklist.
- Participating in contract negotiations on behalf of the organisation
- Drafting contracts between the organisation and other parties
- Vetting legal documents and agreements entered into between the organisation and other parties
- Keeping track of all the agreements entered into by the organisation so that they are up to date.
- Representing the organisation in all judicial and quasi- judicial functions
- Make follow up on outsourced cases to advocate and keep track of the court proceedings
- Preparing legal defence and documentation in respect of court cases
- Conducting necessary research and documentation in respect of court cases
- Instituting court cases on behalf of the organisation
- Participating in mediation and arbitration process in court and other legal tribunals
- Provide legal support and technical advice to Wealthnet in drafting, implementation, review, and amendment of policies, contracts, Memoranda of Agreements (MOUs), and other relevant instruments.
- Managing and monitor risks to which the Legal Services Unit is exposed
- Serve as the Company Secretary
- Prepare legal opinion and brief for management
- Coordinating and managing the Governance and Legal Committee
- Support legal issues for companies under Mvuma Group
- Perform any other duties and tasks as may be assigned or delegated.
COMPETENCIES
- Ability to work as part of the team;
- Strong management and critical thinking skills;
- Outstanding analytical and problem-solving abilities;
- Proven practical experience in compliance monitoring and enforcement mechanisms
- Knowledge of a variety of reporting procedures, regulations and law;
QUALIFICATIONS AND EXPERIENCE
- A Bachelor’s Degree in Law from a recognised and accredited institutions;
- Membership of the Malawi Law Society (MLS).
- Unconditional admission to the Malawi Bar
- Possession of a valid practicing license
- At least one year Practical legaL experience.
